La facilidad probatoria en el Procedimiento de Tutela Laboral. Constitucionalidad y tramitación procesal

Abstract

A principle that facilitates the efforts of proof was introduced by labor guardianship proceedings in the article 493 of the Chilean Labor Code. In this regard much discussion has held about its constitutionality, relating to the general rule of burden of proof, according to Chilean Civil Code Article 1698. The object of this paper is to answer critics to this institution from the perspective of Civil Procedure doctrine. To accomplish this, the work analyzes principles that had guided the civil procedural reforms, along with the relevance of the right of proof, and on whom should have the burden of proof. The paper includes a conceptualization of change of burden of proof and some relevant criteria to the subject in both national and compared laws to affirm this institution is fully compatible with a democratic rule of law. Also, the paper is aimed to answer the criticism about the legal proceedings of this rule, offering an interpretation according to both Chilean Constitution and due process of law.
