Abstract

One of the priorities of the competition agencies is the detection and sanction of collusive agreements, however, in most of the legislations for the configuration of this anti-competitive practice the concurrence of two or more autonomous wills is necessary, a situation that is tested when we are facing a single economic entity. This article carries out a transversal analysis of Ecuadorian legislation, complemented with leading cases and doctrines of the European Union competition regime, with the purpose of exposing the cases which, despite the existence of undertakings that in principle are different, form a single economic unit and therefore are exempt from the prohibition of collusive agreements. As a case study, the sentence issued in judgment No. 09332-2022-18255 will be analyzed.
