In this paper the author proposes a critical position about the incorporation of the Robert Alexy balancing test like a suitable method to solve the cases of collision of fundamental rights in the procedure of Labor Guardianship. To achieve this aim the author analyzes the internal structure of the proportionality principle; the sub-principles of adequacy, necessity and proportionality in stricto sensu.
