This article gives a description of the formation of the employment contract in U.S. Employment Law and it shows some of the typical cases of configuration of the same when one of the parties denies its existence. It also describes situations of continuity of labor obligations in cases of mergers, sales of assets and hiring of workers from the competition. It also gives somes comparative notes with Chilean Employment Law.
