Religious freedom in labor relations: from the understanding of labor freedoms to the systematization of the criteria of trend organizations in Brazilian law

Abstract

This study analyzes religious freedom in labor relations, with delimitation for the exercise of certain freedoms in the workplace and for employers with religious ideas. The text is divided into two parts. In the first, it deals with certain freedoms exercised in the labor sphere: from free initiative and its deployment from the employer’s managerial power to religious freedom and its ownership by the natural and legal persons involved. And in the second, it deals with trend organizations, with emphasis on employers who have religious ideas. In the end, criteria on the legitimacy of the requirement of conformity between the employee’s ideology and the organizational trend are systematized.
