The «hyperconnected» against a complicit state: An analysis of the Ecuadorian case

Abstract

Labor relations have changed, technological innovation is the present. However, situations such as the invisibility of psychosocial risks, and the difficulty of reconciling personal life with professional life, do not show practical progress. The present research will highlight the current reality in Ecuador regarding telework; specifically, the incorrect regulation of the right to digital disconnection, in Ministerial Agreement MDT-2022-237, as it undermines the principles of progressivity and normative hierarchy, which is evidence of the little importance given to labor rights in the 21st century, despite being a Constitutional State. In conclusion, neither labor law nor social security regulations show an adaptation to the current reality.
