Determining the legal nature of the services provided by PedidosYa delivery drivers

Abstract

This article uses a qualitative methodology to analyze the legal nature of the services provided by delivery drivers (also known as riders) through the PedidosYa digital application or platform, and its consequences in the legal and social sphere, in accordance with national and international doctrine and jurisprudence. It is determined that this service is of a labor nature and not civil or commercial. In practice, this would constitute a concealment of the employment relationship and a fraud of law in the form of the type of contract used, according to the 1993 Political Constitution of Peru and Supreme Decree 003-97-TR.
